CREDITORS' RIGHTS

You deserve to get paid.

You Have Rights. Enforce Them.

As a Creditor
Just as debtors have rights to be raised in bankruptcy proceedings, so do creditors. Every chapter presents different rights, duties, and obligations for the creditors—and every case presents different legal challenges and questions for the creditors. Our attorneys have years of experience representing secured and unsecured creditors in complex bankruptcy litigation.
Filing Proofs of Claim
Once a debtor files for bankruptcy, the bankruptcy estate is created. Creditors need to file a proof of their respective claim to be able to receive any distribution from that estate. We can help our clients understand, prepare, and file their claim in compliance with the requisite guidelines.
Getting Relief from the Automatic Stay
As soon as a debtor files its bankruptcy petition, most legal actions must stop. This is both to protect the debtor, and to protect creditors by preserving the estate. There are situations where creditors can ask for permission to act against the debtor regardless of the automatic stay. We can navigate the proper procedure to get creditors relief from that automatic stay to protect their interests.
Defending Creditors
>A debtor or trustee may file a lawsuit after filing for bankruptcy in an action called an adversary proceeding. We are well equipped to defend creditors in these proceedings through all stages of its specialized litigation.
Representing Creditors
In addition to its rights to a distribution of the bankruptcy estate, creditors can also file complaints against the bankruptcy estate. These often involve objections to plans, non-dischargeability actions, or challenges to priority. We are here to help creditors understand and assert their rights.
Collecting From the Debtor Through State Court
Regardless of whether a debtor has filed for bankruptcy, creditors have the right to be paid. Our attorneys combine their trial and financial expertise to enforce our client’s rights in state and federal court.
