Chapter 7 Liquidation
Filing for Chapter 7 bankruptcy is an option for some individuals. Most people are able to keep most or all of their assets, eliminate most or all of their debt, and get a fresh start under this chapter. Immediately after a client files, all creditors are required to stop collection activities, foreclosures, garnishments, and litigation.
Chapter 11 Reorganization
Some individuals will file under Chapter 11 when they want to stay in control of the bankruptcy process. Under Chapter 11, individuals can obtain breathing space while they develop a debt repayment plan, often eliminating large debts and interest payments in the process. As soon as a client files, all collection activities, foreclosures, garnishment actions, and litigation will automatically stop.
Chapter 13 Reorganization
Individuals may also file under Chapter 13. This is a repayment program available for individuals whose priority is to fend off foreclosure or repossession. This chapter allows debtors to restructure their debts in order to keep the assets that are most important to them. Filing will immediately stop creditors from collection activities, foreclosures, garnishments, and litigation.
